Marching Band Educational Use Video Agreement

A school must complete and submit the form no later than seven days prior to the contest where the school wishes to video their marching band's performance.

On behalf of the school named above, I understand and agree that UIL will allow the school to make a single audio/video recording (video with audio) of each of the school’s marching band performances at the region, area, and state marching band contests. I agree to the following conditions:

1. Videos of the school’s marching band performances may be made at the region, area, and state contest, only from a filming location determined by the UIL.
2. Only one copy of each of the school’s marching band performances at a UIL contest may be created.
3. Videos of performances at a UIL marching band contest may be used by the school’s band director for educational purposes only.
4. The school may not make any commercial use of the video and may not allow any third party to receive a commercial benefit from or otherwise make use of the video.
5. The video of the school’s marching band may not be copied or duplicated in any format and may not be made public or distributed to any person.
6. The school, under UIL rule, is solely responsible for obtaining any and all copyright licenses or other approvals that are necessary for the creation and use of the video for an educational purpose only.
7. The school understands and agrees that it is solely responsible for any liability that may arise from the making of this video and any subsequent use that is not authorized by this agreement. Further, should the school hire a third party contractor to create the video, the school understands and agrees that it is fully responsible for the acts of the third party as well as any claims by or against the third party. The third party contractor must be informed of the restrictions on this video and must agree to abide by the terms of this agreement.

This agreement is not a contract, as this form may be modified at any time by UIL. I understand and agree that this agreement does not create any duties or liability that UIL does not otherwise have. Furthermore, this agreement does not give any party any rights that the party would not have absent this agreement. UIL, UT Austin and UT System and a signatory school retain all legal rights and defenses provided by law.
